Privacy Policy
The Personal Data Protection Act 2010 (“PDPA”) has come into force on 15 November 2013 and its aim is to regulate the processing of personal information in commercial transaction and to safeguard the interest of individuals. We, I-Berhad value and respect your personal information and your privacy. This Personal Data Protection Policy explains how we collect and handle your personal information in accordance with the PDPA.
1. Collection/ Source of Data
In the course of your dealings with I-Berhad Group of Companies (collectively, referred to as "us", "our" or "we" in this Personal Data Protection Policy), you may be requested to provide your personal data ("Personal Data"), to enable us to enter into transactions with you or to communicate with you on the services and/or products related to our business. These may be done through various means, including but not limited to:
(a) our forms whether in electronic or hardcopy format;
(b) any correspondence that we have received from you requesting for information or making any inquiries; and/or
(c) business cards or other information provided to us.
2. Types of Personal Data
Such Personal Data may include, but is not limited to information concerning your name, age, identity card number, passport number, address, email address, gender, date of birth, marital status, occupation, income range, contact information such as telephone, mobile and facsimile number, race, nationality, type of loans applied for in relation to the purchase of property, and information of third parties such as your emergency contact person, tenant, authorised representatives, contractors, lawyers, and financiers, which may be subject to applicable data protection and other similar laws.
3. Processing Purposes
We process your Personal Data for, amongst others, the following purposes (collectively, “Purpose”):
(a) those purposes provided for in any particular service or product offered by us or our business partners;
(b) to administer and carry out our customer and prospective customer relationship management procedures;
(c) maintaining our records of our customers and prospective customers and our internal record keeping;
(d) conducting marketing, client profiling and business development activities as well as market research and statistical analysis and customer surveys regarding our projects, products and/or services;
(e) processing your application under any of our programme;
(f) if you are applying for a job or internship with the Group, in addition to the purposes set out here, for evaluating and assessing your eligibility for employment or internship as the case may be, and if you are successful, for the subsequent preparation and execution of the relevant contract of service and documents and administration of the employment/internship;
(g) complying with any legal or regulatory requirements and to make the necessary disclosures under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular and/or code which are applicable to us and for the prevention of crime;

4. Disclosure
Generally, we will keep the Personal Data provided to us as confidential. Nevertheless, you consent to the following disclosures of the Personal Data by us to these classes of third parties which may be located within or outside Malaysia for reasons relating to the Purpose:
(a) any parties to whom we are under a legal requirement to disclose the Personal Data to by applicable law or in response to an authoritative body, including government agencies, statutory authorities, local councils and/or industry regulators including but not limited to the land office, the land registry, the Ministry of Urban Wellbeing, Housing and Local Government, the Employees Provident Fund Board the Inland Revenue Board, as well as to any other third party pursuant to any court order;
(b) contractors and service providers, including but not limited to auditors, consultants, accountants, lawyers, financial and professional advisers, lenders, insurance companies and property management companies;
(c) our subsidiaries, associates, affiliates and/or members within the I-Berhad Group of Companies; and/or
(d) our joint venture and business partners.
5. Protection of Personal Data
Your Personal Data is important to us. We are committed to keeping and processing the Personal Data in a secure matter. We will implement appropriate administrative and security safeguards, procedures and policies to the extent practicable and in accordance with applicable laws, to prevent any unauthorized and unlawful processing of the Personal Data and the accidental loss, destruction or damage to the Personal Data at all times.
6. Consequences of Refusal/ Failure to Supply Data
The refusal or failure to provide the Personal Data may result in the following:
(a) the inability of parties to formalize and/or carry out the relevant agreement or transaction in relation to the sale of our property, products and/or services;
(b) the inability for us provide you with the information, products and/or services requested; and/or
(c) the inability to provide you information about our products and/or services and obtaining your feedback on our products and/or services.
7. Access/ Amendment of Data
You have the right to:
(a) check whether we hold or use the Personal Data and request access to the same;
(b) request that we correct any of the Personal Data that is inaccurate, incomplete or out-of-date;
(c) communicate to us your objection to the use of the Personal Data for marketing purposes;
(d) withdraw, in full or in part, your consent, subject to any applicable legal restrictions, contractual conditions and reasonable time period.

8. Consent from Third Parties
In the event you have provided personal data of third parties (e.g. your emergency contact person, tenant, authorised representatives, contractors, lawyers, financiers) to us, we rely on you to have sufficiently obtained the prior consent of such third parties to allow us to process their personal data in relation to the above Purposes.
9. Changes to our Personal Data Protection Policy
We may, from time to time, need or be required to change our Personal Data Protection Policy to comply with or be consistent with changes in applicable law and regulations as well as our business operations or policies. As such, you may wish to review any changes to our Personal Data Protection Policy at our website from time to time.
10. Internet and mobile application use
You acknowledge that the provision of your personal data to us over the Internet is entirely at your own risk.
You further acknowledge that if you post your rating and/or review on the app/website, your rating and/or review will become a public information and will be retained by us even after your account has been terminated. Your email address and phone number will not be visible to others through any rating and/or review that you post.
If any part of the app/website links you to other websites, those websites do not operate under this Privacy Policy and we do not accept any responsibility or liability arising from those websites. We suggest you to read and understand those websites’ privacy policy before you provide your personal data to those websites.
We use cookies (an alphanumeric identifier that we transfer to your computer’s or mobile device’s hard drive so that we can recognise your web browser or mobile device, track your visits to the app/website or remember your username and/or password each time log-in) to monitor your use of the app/website. All such demographic data collected through cookies are not personal data and we may use this data in aggregated, statistical and/or anonymised form. You may disable cookies by changing the settings on your web browser or mobile device, although this may mean that certain features on the app/website will not function properly if you set your web browser or mobile device to not accept cookies.
In addition to using cookies and related technologies as described above, we may also permit certain third party companies to help us tailor advertising that we think may be of interest to users and use other data about user activities on our app/website (e.g., to allow them to tailor ads on third party services). These companies may deliver ads that might also place cookies and otherwise track user behavior.
Please note that when you first install our mobile application on your mobile device, we will set up an account associated with that mobile device (“Account”). We will collect and use your personal data, in accordance with this Privacy Policy, whenever you activate our mobile application on that mobile device. This use includes linking your personal data with your Account. Most mobile platforms (iOS, Android, etc) have different permission systems for obtaining your consent. The iOS platform will alert you the first time our mobile application wants permission to access certain types of data and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that our mobile application seeks before you first use the mobile application, and your use constitutes your consent.
The app/website may integrate with social sharing features and other related tools which allow you to share information with your friends or the public, depending on the settings you establish with the social sharing network. The social sharing network’s use of your personal data made available by i-City is governed by that social sharing network’s privacy policy, not by this Privacy Policy. By connecting your social sharing network account through the app/website, you agree that we may collect your personal data from your social sharing network account only in accordance with your privacy settings you have set up under your social sharing network account and for the purposes provided under this Privacy Policy.
We may automatically receive, record and store location services information from your computer or mobile device when you interact with us. You hereby consent to our use of anonymised location services information collected from you. Where the location services information is personally identifiable, we will give you the options to manage your disclosure of this information. Depending on the functionalities available on your computer or mobile device, you may benefit from advanced options to manage the location services information. A computer or mobile device may report its GPS location at the time you interact with us if the location services settings are enabled. Such information is not identified as personal data, except where we are required to do otherwise under applicable law.
Our collection of your computer or mobile device location information is solely at your discretion. You can enable or disable location services when you use the app/website at any time, through your computer or mobile device settings. Should you use the app/website with location services enabled, you consent to our collection and dissemination of your computer or mobile device location information through the app/website, as specified in this Privacy Policy. Under no circumstances shall we be liable for claims or for any damages therefrom, arising out of your informed decision to allow other users to see your computer or mobile device location information, as specified in this Privacy Policy.
